Irving Man Accused of Assaulting Elderly Mother, Kicking Officer During Arrest

IRVING, Texas — An Irving man is facing multiple felony charges after police say he assaulted his elderly mother and then kicked an officer while being taken into custody.

On Saturday, February 21, 2026, at approximately 2:35 p.m., Irving Police officers responded to the 1600 block of Windsong Lane in South Irving near South Irving Heights Road following a 911 cellphone call reporting a disturbance.

When officers arrived, they detained 36-year-old Nathan McGiboney inside the residence. According to police, the victim, a 69-year-old woman identified as McGiboney’s mother, told officers the two lived together at the home and that her son had assaulted her.

Officers had previously responded to an earlier altercation at the residence but left after the situation appeared to calm down. The victim told investigators that after officers departed, McGiboney became angry and attacked her, allegedly throwing her to the ground, punching her in the mouth, and forcing his hand into her mouth, causing visible injuries.

McGiboney was taken into custody on a domestic violence charge. While officers were escorting him to a patrol vehicle, police say he intentionally kicked an officer in the right leg, causing pain.

Officers then took McGiboney to the ground, where he continued resisting arrest by kicking his legs, flailing his body and head, and refusing commands. He was eventually subdued by force and transported to the Irving Jail.

McGiboney was charged with Injury to an Elderly Individual, Assault on a Public Servant, and Resisting Arrest. The following day, he was transferred to the Dallas County Jail, where he remains in custody. Dallas County Judge Janice Wolff set his total bond at $21,500.

Court records show McGiboney has a prior conviction for indecent exposure dating back to March 2015. In that case, investigators said he pulled his pants down and exposed himself to children while walking near homes on Windsong Lane, just a few houses from his current residence. Originally charged with Indecency with a Child, the offense was later reduced to Indecent Exposure, and he received 18 months of probation under a plea agreement.
