IRVING, Texas - A 42-year-old man faces multiple charges after Irving Police say he was found highly intoxicated following a crash on Airport Freeway, repeatedly wandered into traffic, resisted arrest, kicked an officer and spit in another officer's face.
Irving Police responded at approximately 5:29 a.m. Saturday, Aug. 22, to a minor crash on the westbound main lanes of W. Airport Freeway (SH-183) near N. Belt Line Road. The caller reported seeing two disabled vehicles.
Officers contacted the driver of a black 2018 Chevrolet Equinox, later identified as 42-year-old Benjamin Lee Elliott.
According to the arrest report, Elliott was standing near the Chevrolet with a blank stare and was swaying heavily. Police said he appeared unable to stand straight and repeatedly stumbled into active traffic lanes.
Elliott declined medical attention and was described by the responding officer as incoherent, with thick, slow and slurred speech. Investigators said he would not answer questions about the crash.
Because Elliott continued stepping into traffic, officers placed him in handcuffs and moved him away from the roadway for his safety, according to the report.
Police said Elliott admitted that he had smoked and consumed alcoholic beverages before driving. Based on his statements and observed signs of intoxication, an officer determined Elliott had lost the normal use of his mental and physical faculties and placed him under arrest for Driving While Intoxicated.
Police Say Suspect Kicked Officer and Spit in Another's Face
The encounter allegedly became physical as officers attempted to place Elliott inside a patrol vehicle.
According to the arrest report, Elliott straightened his legs, stiffened his body and pushed himself away from the patrol vehicle while refusing officers' commands.
Police allege Elliott then kicked toward the officers and struck one officer in the leg, causing pain.
While officers continued placing him inside the patrol car, Elliott allegedly intentionally spit in an officer's face.
Officers also asked Elliott to provide his legal name following his arrest. Instead, according to the report, he identified himself as "OG MUTHA F***** TREY O."
During an inventory search of the Chevrolet, police located Elliott's Texas driver's license and confirmed his identity. An NCIC check then revealed that Elliott had several outstanding warrants, according to the report.
Officers also reported finding a 750-milliliter bottle of Sheridan's coffee layered liqueur with a broken seal in the back seat of the vehicle.
In addition to DWI, Elliott was charged with Failure to Identify Fugitive, Resisting Arrest, Assaulting a Peace Officer and Harassment of a Public Servant.
