Irving Man Sentenced to 25 Years for Sexually Abusing 7-year-old Child

DALLAS, Texas—An Irving man has been sentenced to 25 years in the Texas Department of Criminal Justice (TDCJ) after pleading guilty to sexually abusing a 7-year-old child.

Kelbin Roberto Ortega-Hernandez, 40, was sentenced on July 28, 2025, after initially pleading not guilty. The plea agreement addressed charges of Sex Abuse of Child Continuous: Victim Under 14. The abuse involved sexual intercourse.

The victim, a student at Otis Brown Elementary School in South Irving, is protected by a lifetime restraining order. School officials and personnel from the Irving Family Advocacy Center were subpoenaed as part of the investigation.

Ortega-Hernandez, who is an undocumented immigrant and requested a court interpreter, was arrested by Irving Police on April 23, 2024, after the child reported the abuse at school. He has been in custody since his arrest, with bail denied. He was booked into the Irving Jail and later transferred to the Dallas County Jail.

The court records do not specify if Ortega-Hernandez and the victim were related, to protect the victim's privacy. He has prior convictions for Driving While Intoxicated (DWI) and drug offenses.

In May 2025, Ortega-Hernandez had requested to dismiss his lawyer, claiming the lawyer was not taking the case seriously and only presented plea offers. This request was denied. He ultimately accepted a last-minute plea deal with the Dallas District Attorney's Office. He is also required to register as a sex offender.
