Nearly every court story we publish references a felony "degree" — state jail felony, third-degree, second-degree, first-degree, or capital. These aren't arbitrary labels; each one carries a specific, statutory punishment range under Chapter 12 of the Texas Penal Code. Here's what each level actually means.
The Five Felony Classifications
Capital Felony
The most serious classification in Texas, reserved for capital murder. Punishable by death or life imprisonment without parole, depending on whether the state seeks the death penalty. There is no fine range or probation option at this level.
First-Degree Felony
Punishable by 5 to 99 years or life in prison, plus a fine of up to $10,000. Common first-degree offenses include murder (that doesn't rise to capital murder), aggravated robbery, aggravated kidnapping, aggravated sexual assault, and serious drug trafficking or money laundering charges.
Second-Degree Felony
Punishable by 2 to 20 years in prison and a fine of up to $10,000. Sexual assault, intoxication manslaughter, and many aggravated assault charges commonly fall into this category.
Third-Degree Felony
Punishable by 2 to 10 years in prison and a fine of up to $10,000. Examples include continuous family violence, evading arrest in a vehicle, stalking, and intoxication assault in most circumstances.
State Jail Felony
The lowest felony classification, created by the Texas Legislature in 1993 to help address prison overcrowding tied to drug-related offenses. Punishable by 180 days to 2 years in a state jail facility, plus a fine of up to $10,000. Common examples include possession of certain controlled substances, theft of property valued under $2,000 with prior theft convictions, credit card abuse, and DWI with a child passenger in the vehicle.
How Prior Convictions Change the Range: Enhancement
Texas law allows prosecutors to "enhance" a felony charge to a higher punishment range when the defendant has prior felony convictions, under Penal Code Sections 12.42 and 12.425. For example, a defendant facing a third-degree felony charge with one qualifying prior felony conviction can be punished within the second-degree range instead. Habitual offender provisions can push repeat offenders into even higher ranges, including, in some circumstances, a minimum 25-year sentence. This enhancement process is one reason two defendants charged with what looks like the identical offense can face very different sentencing exposure.
Misdemeanors, for Comparison
Below felonies, Texas misdemeanors are divided into three classes. Class A misdemeanors carry up to one year in county jail and a fine up to $4,000. Class B misdemeanors carry up to 180 days in jail and a fine up to $2,000. Class C misdemeanors are fine-only offenses, capped at $500, with no jail time authorized and no right to a court-appointed attorney since no jail time is at stake.
Probation Eligibility Varies by Class
Whether a defendant can be sentenced to probation instead of incarceration depends heavily on the specific offense, the degree of felony, and criminal history — some offenses, like sexual assault of a child, are excluded from judge-ordered probation entirely except in narrow circumstances. State jail felony probation is governed by its own separate rules and is, in some respects, broader than probation eligibility for higher felony classes.
