IRVING, Texas - A 34-year-old woman already serving probation in two Parker County criminal cases has been arrested after police say she assaulted her 66-year-old stepfather during a disturbance outside an Irving restaurant.
According to the Irving Police Department, officers responded at approximately 11:15 p.m. on Aug. 1 to a domestic disturbance in progress at the KFC located at North Belt Line Road and West Rochelle Road.
The victim's wife called 911 to report that her daughter, identified as Nicole Alejandra Batterbee, had assaulted her 66-year-old stepfather.
Investigators said the victim has been Batterbee's stepfather for the past 17 years and remains a father figure in her life.
According to police, the victim had gone to the restaurant to pick up Batterbee because she was experiencing sobriety issues.
While at the restaurant, Batterbee allegedly became verbally aggressive and began arguing with the victim.
During the confrontation, police said Batterbee intentionally kicked the front passenger door of the victim's SUV, causing damage to the vehicle.
The arrest affidavit then states taht she scratched the victim on the right side of his neck.
Responding officers observed a fresh scratch extending from the right side of the victim's neck toward the upper portion of his chest. Police said the injury was visibly red and had broken the skin.
Before officers arrived, Batterbee fled the scene.
An alert with her description was broadcast to officers, and a short time later another Irving officer located her at the Uno China Buffet in the 3400 block of Grande Boulevar, a short distance from the original incident.
She was taken into custody without incident and booked into the Irving Jail.
Batterbee is charged with injury to an elderly individual with intent to cause bodily injury, a third-degree felony under Texas law.
The victim declined to pursue criminal charges related to the damage to his vehicle.
Court records show Batterbee, who has reportedly lived in Hudson Oaks, was previously arrested by Parker County deputies in May 2025 on charges of driving while intoxicated, possession of marijuana and possession of a Penalty Group 2 controlled substance.
She was later found guilty in that case and, on Jan. 20, 2026, received three years of deferred adjudication probation along with 160 hours of community service.
Three days later, on Jan. 23, 2026, Batterbee was sentenced in a separate Parker County case after being convicted of second-offense driving while intoxicated. In that case, she received 18 months of probation and was ordered to complete an additional 80 hours of community service.
Because Batterbee remains on probation in both cases, the new felony charge could result in probation violation proceedings in Parker County.
