Irving Man Arrested for DWI, Gun Assault After Apartment Disturbance in Valley Ranch

On Tuesday night, September 16th, at approximately 10:56 p.m., Irving Police officers were dispatched to the Valley Trails Apartments in the 8900 block of E. Valley Ranch Parkway following reports of a disturbance and possible shots fired.

Officers arriving on the scene observed the suspect, 26-year-old Nikolay Frank, driving through the parking lot. He was detained at gunpoint until additional officers arrived and took him into custody. Frank displayed signs of intoxication, including the smell of alcohol, bloodshot and glassy eyes, slurred speech, and unsteady movements. He admitted to consuming at least three shots and two beers that evening.

A field sobriety test revealed all six clues of Horizontal Gaze Nystagmus and vertical gaze nystagmus. Frank consented to a breath test, which measured a blood-alcohol content of 0.148.

During the investigation, officers spoke with two victims and three witnesses, who reported that Frank had brandished a firearm, struck one victim, a woman, in the face, and pointed the weapon at two others during an argument, placing them in fear of serious bodily harm. Frank fled the scene before officers arrived, but was later located driving in the apartment complex parking lot.

A loaded 9mm Sig Sauer P320 was found on the driver’s floorboard of his truck.

Frank was booked into the Irving Jail and charged with DWI, Unlawful Carrying of a Weapon, and two counts of Aggravated Assault with a Deadly Weapon.
