Kroger Rezoning Request to Allow Selling of Alcohol Near School

This Thursday night, Irving's City Council will discuss Kroger's request ZC#10-0052 for a zoning change to allow them to sell alcoholic beverages at the store located at 515 S. MacArthur Blvd in South Irving.
 
The zoning change will allow Kroger to sell alcohol less than 300 feet from John Haley Elementary School.   Haley is located at 1100 Schulze Dr (as seen on the map).  Kroger's property line is about 240 feet from the school's property line.
 
The City ordinance, approved two years ago, requires a minimum of 300 feet separation from property line to property line which also matches the state law.  Kroger is asking for a variance of 60 feet to allow them to sell beer and wine at their store.
 
Many Irving residents oppose this request and are calling for action.   Those opposing the request are asked to wear red and to speak out at the Council meeting.
 
The South Irving Property Owner's Association (SIPOA) issued this statement on the subject, "If this variance is granted, it will set a precedent and other stores will ask for a variance because of being at a competitive disadvantage.  The small convenience store at the corner of Oakdale Rd and Story Rd. currently cannot sell beer and wine because it is too close to Elliot Elementary.  The gas station at the corner of Loop 12 and Shady Grove can not sell because it is too close to Schulze Elementary.  There are many such situations across Irving that may be challenged if this variance is given."
