Ellis County Jury Returns Not Guilty Verdict in Sexual Assault Case

ELLIS COUNTY, Texas — A jury has returned a not guilty verdict in a case involving allegations of sexual assault and assault family violence, according to the Ellis County District Attorney’s Office.

District Attorney Lindy Beaty announced that the verdict was delivered May 5 following a trial centered on claims of sexual assault and assault family violence impeding breath.

According to prosecutors, the case stemmed from an incident reported about a month after it allegedly occurred, when the adult complainant sought medical treatment for neck pain. Medical staff contacted law enforcement, and the complainant reported that a verbal argument escalated into physical violence, including choking and sexual assault.

Prosecutors said the complainant alleged a second incident the following morning in which she was again choked while attempting to leave.

During the trial, jurors heard testimony addressing the dynamics of the relationship, including statements from a counselor who previously provided a safety plan, as well as medical professionals who discussed the risks associated with strangulation. An expert on intimate partner violence also testified about common misconceptions surrounding abusive relationships.

The defense raised questions regarding the complainant remaining with the defendant following the alleged incidents, which prosecutors said the complainant attributed to fear and planning an eventual exit.

Because the jury returned a not guilty verdict, officials said the defendant is eligible for expunction. Authorities did not release the defendant’s name.

The district attorney’s office thanked jurors, the Mansfield Police Department and medical professionals involved in the case, noting the importance of reporting both convictions and acquittals.
