Waco Man Sentenced to 50 Years for Murder and Assault in Convenience Store Shooting

Charles Ervin, 31, was sentenced to 50 years in prison on October 14, 2024, after pleading guilty to multiple charges, including Murder, Aggravated Assault, Retaliation, and Injury to a Child. Ervin entered his plea just moments before his jury trial was set to commence in the 54th District Court.

The charges stem from an April 3, 2023, shooting incident in the 1800 block of Richter Street in Waco, resulting in the death of 24-year-old Zachary Hughes. On that day, Ervin recognized a vehicle belonging to Hughes parked at a convenience store. He then turned his vehicle around, exited with a gun, and fired at least 13 shots at Hughes's car.

Hughes suffered a fatal gunshot wound, and two other individuals inside the vehicle were also injured during the shooting.

Prosecutors were prepared to present testimony from multiple witnesses, including Waco Crime Scene Investigators. They utilized security camera footage to identify the masked shooter, who had touched a nearby vehicle during the crime. Investigators collected fingerprints and DNA evidence from that vehicle, which matched Ervin.

When police arrived at Ervin's residence with an arrest warrant, he was discovered hiding in the attic. A subsequent search of his home revealed clothing that matched what he was seen wearing in the murder footage.

Given Ervin's prior criminal history, he faced a sentence of 25 to 99 years or life imprisonment on all charges. Due to the nature of his offenses, he must serve a minimum of 25 calendar years before being eligible for parole consideration.

The case was prosecuted by Assistant District Attorneys Christi Hunting Horse and Rebeckah Lawson from the Gang Unit. They praised the Waco Police Department's investigation, stating, "This case featured an exceptional investigation. Along with our law enforcement partners, we will continue to aggressively target gang violence in our community."
